Terms & Conditions
1. Payment Terms. Payment is due upon receipt of the invoice, unless otherwise agreed in writing with TBAD. All payments must be made via EFT to the bank account details provided on the invoice. Payments should be made in South African Rand (ZAR).
2. Late Payment Penalties. Should payment not be received within 30 days from the date of the invoice, interest will be charged at a rate of 2% per month on the outstanding balance - unless otherwise stated. Interest will accrue daily from the 32nd day until full payment is received. Failure to settle the outstanding balance and accrued interest may result in suspension of services and/or legal action.
3. Disputes. Any disputes regarding the invoice must be communicated to TBAD in writing within 7 days of receipt of the invoice. Disputed amounts will not delay payment of the undisputed portions of the invoice.
4. Amendments to Terms. Any amendment or waiver of these terms must be agreed upon in writing by TBAD. TBAD reserves the right to amend these terms at any time, with reasonable notice to the client.
5. Project Scope and Additional Services. The invoice reflects the work completed as per the agreed scope of services. Any additional work outside the initial scope will be invoiced separately and will be subject to the same payment terms.
6. Termination of Services. In the event of non-payment, TBAD reserves the right to terminate or suspend services until the account is settled. Termination of services does not waive TBAD's right to collect the outstanding amount, including interest and any legal fees incurred in the collection process.
7. Governing Law. These terms and conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the South African courts.
